The establishment of the Spanish Agency for the Supervision of Artificial Intelligence (AESIA) aligns with the country’s national digital strategy, aiming to ensure that AI advancement in Spain embodies principles of inclusivity, sustainability, and citizen-centricity. With this, Spain has become a pioneer within the European Union by creating its own task force dedicated to regulating artificial intelligence (AI).
On August 22nd, the Council of Ministers gave its approval for a Royal Decree that formalized the AESIA. This agency will be a collaborative effort of the Spanish Ministry of Finance and Civil Service as well as the Ministry of Economic Affairs and Digital Transformation.
The AESIA is a key component of Spain’s overarching plan known as the National Artificial Intelligence Strategy. Spain’s ambition is to take a leadership position in the AI domain. Notably, Spain has become the first European nation to establish a specialized agency for overseeing AI matters.
In June, the European Union introduced the Artificial Intelligence Act, a legislative framework designed to regulate and supervise AI-related activities. Once implemented, this legislation will impose restrictions on various AI services and products while outright forbidding others. Specific technologies that will face a complete prohibition include biometric surveillance, social scoring systems, predictive policing algorithms, emotion recognition software, and indiscriminate facial recognition systems.
However, AI models of a generative nature, such as OpenAI’s ChatGPT and Google’s Bard, will be permitted to operate as long as their outputs are clearly identified as AI-generated. The EU’s AI Act mandates all member countries to establish their own national agencies tasked with overseeing artificial intelligence matters.
